Terms of Service

1. Acceptance of Terms

By accessing or using the FaceVault API, website, dashboard, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree, do not use the Service.

3. Account Registration

• You must provide a valid email address and create a secure password.
• You are responsible for maintaining the confidentiality of your account credentials and API keys.
• You must notify us immediately at support@facevault.id if you suspect unauthorised access to your account.
• One person or entity may not maintain more than one free-tier account.

4. API Usage

The FaceVault API is provided for the sole purpose of identity verification. You agree to:

• Use the API in accordance with the documentation
• Not exceed reasonable rate limits (currently 60 requests per minute per API key)
• Not reverse-engineer, decompile, or attempt to extract the source code of the Service
• Not resell or redistribute API access without written permission
• Implement appropriate error handling and not retry failed requests in tight loops

6. Acceptable Use

You agree not to use the Service to:

• Build surveillance systems, facial recognition databases, or tracking tools
• Verify identities without the end user’s informed consent
• Process data of individuals under 18 years of age
• Violate any applicable law, regulation, or third-party rights
• Transmit malware, exploit vulnerabilities, or attempt to compromise our infrastructure
• Circumvent usage limits, rate limits, or authentication controls
• Conduct stress testing or load testing without prior written approval

Violation of this section may result in immediate account suspension without notice.

7. Data & Privacy

Our collection and processing of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

As a Developer, you are responsible for:

• Obtaining proper consent from end users before submitting their data for verification
• Providing end users with a clear privacy notice that discloses the use of FaceVault for identity verification
• Complying with all applicable data protection laws (including GDPR, where applicable) in your use of the Service
• Not storing or retransmitting biometric data received from FaceVault beyond what is necessary for your lawful purpose

8. Intellectual Property

The FaceVault name, logo, API, documentation, and website design are the property of FaceVault. These Terms do not grant you any rights to our trademarks or branding.

The AI models used in the FaceVault pipeline (MediaPipe, ArcFace, OpenCV, face-api.js) are open-source projects governed by their respective licences. Our use of these models does not transfer any additional rights to you.

9. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted service. The Service is provided on an “as is” and “as available” basis. We may perform maintenance with reasonable notice when possible, but reserve the right to perform emergency maintenance without notice.

We are not liable for any downtime, data loss, or service interruption caused by events beyond our reasonable control, including but not limited to internet outages, third-party service failures, or force majeure events.

10. Limitation of Liability

To the maximum extent permitted by law:

• FaceVault shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities
• Our total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid to FaceVault in the 12 months preceding the claim
• We do not warrant that verification results are 100% accurate. Identity verification is probabilistic by nature, and false positives or false negatives may occur

11. Indemnification

You agree to indemnify and hold FaceVault harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights, including end users’ privacy rights.

12. Termination

• By you: You may close your account at any time by emailing support@facevault.id. Your API keys will be revoked immediately.
• By us: We may suspend or terminate your access if you breach these Terms, engage in abusive behaviour, or fail to pay outstanding invoices. We will provide notice where reasonably practical.
• Effect of termination: Upon termination, your right to use the Service ceases immediately. Sections 7 (Data & Privacy), 10 (Limitation of Liability), 11 (Indemnification), and 14 (Governing Law) survive termination.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email to registered developers at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
